By using Vigil (the “App”), you agree to these Terms of Service. If you do not agree, do not use the App.

Guidelines, not law — and not medical advice

Vigil is a reference and practice companion, not an authority. Fasting information in the App reflects common traditional practice presented as guidelines; observance varies by jurisdiction, parish, and person, and the guidance of your own priest always takes precedence over anything in the App. The App does not provide pastoral care, spiritual direction, or medical advice. Consult a qualified healthcare provider before undertaking any fasting practice that could affect your health, and do not delay seeking medical care because of anything in the App.

License

We grant you a personal, non-transferable, revocable license to use the App for your own non-commercial purposes, subject to these Terms and the Apple Media Services Terms.

Purchases, subscriptions & billing

The core of the App (today's fasting guideline and the saint of the day) is free. The optional Vigil+ unlock is sold through the Apple App Store and billed to your Apple ID in three forms:

  • Vigil+ Monthly — $2.99/month, auto-renewing subscription
  • Vigil+ Annual — $19.99/year, auto-renewing subscription
  • Vigil+ Forever — $39.99, a one-time lifetime purchase with no renewal of any kind

Auto-renewal. Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the period ends. Your Apple ID is charged for renewal within 24 hours prior to the end of the current period.

Cancellation. Manage or cancel subscriptions any time in your App Store account settings (Settings → your name → Subscriptions on your device). Deleting the App does not cancel a subscription. Upon cancellation, access continues until the end of the paid period; unused portions are handled per Apple's standard policy.

Refunds. All billing is handled by Apple; we never see your payment details. Refunds are requested from Apple at reportaproblem.apple.com and are governed by Apple's refund policy.

Restore Purchases is available in the App's Settings. If you reinstall on the same Apple ID, your previous purchase or active subscription is restored at no charge.

Acceptable use

You agree NOT to:

  • Reverse engineer, decompile, or attempt to extract the source code of the App
  • Copy, distribute, or republish App content without our written permission
  • Use the App in violation of any law
  • Use the App for commercial purposes without our written permission

Intellectual property

The App's original content — explainers, audio recordings, design, and the underlying software — is owned by Tundra Industries or its licensors. Prayer and liturgical texts in the App are reproduced from public-domain translations (principally Hapgood 1906 and Orloff 1897); those historical texts remain in the public domain, while our arrangements, annotations, and recordings of them are proprietary.

Disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TUNDRA INDUSTRIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRIOR TO THE CLAIM.

Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time by uninstalling it.

Governing law

These Terms are governed by the laws of the State of Hawaii, United States, without regard to conflict of laws principles. Any disputes shall be resolved in the courts of that state.

Changes to these Terms

We may update these Terms. When we do, we update the “Last updated” date above. Continued use of the App after changes constitutes acceptance of the new Terms.
